Warning: PAL Photo Contest

Philippine Airlines is currently running a photo contest. The theme is Awakening the Beauty and has a lot of fabulous prizes: Roundtrip tickets to LA, Brisbane, and Hong Kong.

Too bad it’s utterly flawed.

Let’s take a look at #16 in Rules Terms and Conditions. I’m quoting verbatim from their official rules page : http://www.philippineairlines.com/special_offers/photo_contest/photo_contest.jsp (emphasis mine)

1. By entering the contest and submitting his/her entry/ies, each participant agrees and acknowledges that PAL is permitted to receive the photograph or image entry/ies, and that he/she transfers and turns over to Philippine Airlines the full ownership of the copyright to the photos or images.

So what does it mean? Well look at this scenario:
a. You join the contest.
b. You don’t win.
c. You see your photo on a PAL billboard.
d. You ask for payment or even credit. Guess what? You CAN’T!!! Since just by joining you turned over full ownership of your photos!!
Think that’s bad? How about this.
a. You join the contest.
b. You don’t win.
c. You show your photo to a friend.
d. Your friend likes your photo and pays you mucho bucks for an international ad campaign.
e. PAL will now SUE YOU for infringing on the copyright of a photo YOU TOOK because you gave them full ownership just by joining their contest.
Get the picture?
This isn’t new. Organizers who made these rules take advantage of excited and creative photographers and get photos with no money involved. In fairness, there are photo contests with correct rules that only ask for trademark use for winning photos and ownership remains with the photographer. Unfortunately, this is is the exception rather than the rule.
Always check the fine print when you join a photo contest or else you might lose more than you think.
So you still want to join?

Congratulations to VJ Francisco!

VJ’s photo was recognized as “Best Composition & Contrast” by the infamous Scott Kelby during his recent international Photo Walk!

His photo is seen on this entry and can be viewed with the other photos given recognition at http://www.scottkelby.com/blog/2010/archives/11976. There’s another Pinoy there recognized based in Davao, make sure you check it out.

VJ was a graduate of Photoworks Class 46 back in January 2009. The Photo Walk was held last July 24, 2010, led by Mark Terence Sy (also another Photoworks graduate). You can see more of VJ’s work at www.vjfrancisco.com.

Welcome back! The Photoworks Academy site had some problems and reverted to an older version. Some entries in the last few months were lost.

But never mind that! We’re back and we have some new classes 3Q 2010!

First, we have a special treat for you... SKIN: A Nude Photography Workshop by Raymond Latonio! Learn the art of capturing the nude this August 28 at The Photoworks Studio, 2F Amber Place, Jose Escriva Drive, Ortigas. Find out more at http://skin.photoworksacademy.com. This workshop is open to non-Photoworks grads as well, but sign up quickly, we only have limited slots!
